Terms and Conditions for Commission Pieces
Please ensure to read the terms and conditions below prior to submitting your request. Once your form has been submitted and accepted and the artist and art collector have happily agreed to all terms and request, you (artist collector) will receive an updated T&C for you to sign along with a request for initial deposit will be attached. Commission piece will commence upon completion of both these requirements.
Terms and Conditions
The Artwork: The Art Collector, (Your Name) is commissioning the Artist, Rose Mara to paint an original acrylic painting on canvas.
The Concept:The Artist will paint an original painting on canvas
Progress Report:The Artist agrees to communicate with the Art Collector with progress reports during the creation of the work, which can include pictures of the work in progress. The pictures may be digital images and sent by email or phone. During these progress reports, the Art Collector and Artist will communicate openly to ensure the creation of the artwork is connecting with the Art collector.
Payment Amount: The price will be decided by the Artist beforehand and will be based upon canvas size, framing and complexity of the completed work and will be consistent with other comparable works by the Artist at the time of sale. Painting size will be mutually determined by the Artist and the Art Collector. The Art Collector will pay the shipping costs of artwork from Australia to the country of destination including tracking, insurance and destination taxes.
Payment Schedule: A non-refundable deposit of $ to cover the Artist’s initial material costs and initial creative time is required before commencement of artwork. This is usually 50%. The remaining balance of payment is due upon completion of the completed artwork and prior to delivery.
Copyright:The Artist retains the copyright to all works commissioned by the Art Collector that were created by the Artist, including all reproduction rights and the right to claim statutory copyright. No artwork may be reproduced or altered without the written consent of the Artist.
Right of Refusals In the event that the Art Collector does not wish to purchase the commissioned artwork, the Art Collector may refuse. The Art Collector will agree and understand that the Artist will retain the the non-refundable deposit. This is free of any claims or interests of the Art Collector and the Art Collector will not owe any additional fees to the Artist. The Artist will have the right to sell the refused artwork to another Art collector.
In agreeing to this document, the Artist agrees to complete the work as specified and deliver the work to the Collector within the agreed time frame unless specified.
In agreeing to this document, the Art Collector agrees to pay the deposit and final payment price as described above and will take ownership of the artwork on completion of payment.
